These Terms & Conditions ("Terms") are an agreement between you and Every Storm Industries LLC ("we," "us," "our") and govern your use of the Vessalia Health iOS app and this website (together, the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App. If you use the App on behalf of someone you care for, you confirm you are authorized to do so.
Vessalia Health is a personal organization and record-keeping tool. It helps you log and organize information you choose to enter — such as medications, doses, check-ins, appointments, contacts, bills, documents, and notes — and gives you reminders, simple trends, summaries, and exports. All information you enter is stored locally on your device, as described in our Privacy Policy. The App is a general-audience productivity tool, not a healthcare service.
Vessalia Health is not a medical provider, doctor, nurse, pharmacy, clinic, or telemedicine service, and it is not affiliated with any of these. It does not provide medical advice, diagnosis, treatment, or clinical decision-making, and using it does not create a doctor–patient, pharmacist, or other professional relationship.
Any reference alerts (such as shared-ingredient or refill notices), plain-language overviews, trends, and summaries in the App are for general information and your own record-keeping only. They are not a substitute for the judgment of a qualified professional, may be incomplete or inaccurate, and should not be relied on to make health decisions. Always read the labeling that comes with your medications and follow the directions of your own doctor or pharmacist. Never disregard or delay professional advice because of something you saw in the App. In an emergency, call your local emergency number.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your own personal use, subject to these Terms and to Apple's standard Licensed Application End User License Agreement. If any conflict exists between these Terms and Apple's standard EULA regarding your use of the App obtained through the App Store, Apple's standard EULA governs to the extent required.
Your privacy is described in full in our Privacy Policy, which is part of these Terms. In short: Vessalia Health has no servers and collects no data; everything you enter stays on your device unless you choose to export it, turn on optional Apple Health sync, or turn on the optional backup to your own private iCloud. You control your data at all times.
The App runs on Apple platforms and uses Apple technologies — including the App Store, iCloud, HealthKit (Apple Health), EventKit (Calendar), Apple Intelligence, and Siri and App Intents (Shortcuts) — when you choose to use those features. Your use of Apple's products and services is governed by Apple's own terms and privacy policies, which we do not control and are not responsible for.
The App, including its name, design, text, graphics, and software, is owned by Every Storm Industries LLC and is protected by intellectual-property laws. These Terms do not transfer any ownership to you. You may not copy, modify, distribute, sell, or create derivative works from the App except as expressly permitted by these Terms or applicable law. The information you enter remains yours.
The App is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that reminders, alerts, calculations, or summaries will be accurate, complete, or delivered on time. You use the App at your own discretion and risk. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
To the fullest extent permitted by law, Every Storm Industries LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, health outcomes, or goodwill, arising out of or related to your use of (or inability to use) the App — including any reliance on reminders, alerts, overviews, trends, or summaries — even if we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD $25. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Every Storm Industries LLC and its owners, members, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
We may update, change, or discontinue the App or any of its features at any time. We may also update these Terms from time to time; when we do, we will revise the effective date above and, for significant changes, note them in the App's release notes. Your continued use of the App after an update means you accept the revised Terms. The current version will always be available on this page.
These Terms apply for as long as you use the App. You may stop using the App and delete it at any time. We may suspend or end your license if you materially breach these Terms. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the App or these Terms will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.
